My mother was killed instantly as a passenger in an auto accident. The driver of the car she was in is at fault. Is the money awarded to me from the driver's insurance considered part of her estate?

My response:

It goes to the "Estate of (your Mom's name)". Then, the Estate is divided amongst her surviving family, beginning with husband, and then to children.

If you haven't opened an Estate in court for your mother, it's time to do so.
