this matter currently exists in the state of california. what is the legal definition of accidental death & dismemberment? if an alleged suicide (with another individual present at time of death) is deemed a potential homicide, (1) how can the death certificate be changed to reflect homicide? and (2) after 17 months, is insurance company bound to pay out on policy to beneficiary?
i realize that expert testimony would be needed soley based in a wrongful death lawsuit initiated by the deceased's wife. However, if the crime scene was contaminated and this is reflected on the record, won't this make a major difference, for the good, to the wife as beneficiary?
i appreciate your time and knowledge in a reply.
