Advice on Accident Scam


What is the name of your state?Mississippi

On April 1, 2005, I was returning home from my morning shift at work when a woman rear-ended me while I was waiting at a red light. We got out of the highway and pulled to the side and started talking. I noticed that my bumper was cracked, but I had to be back at work in 30 minutes, so I just went against my better judgement and just took her information down, since she said that she would pay for the necessary damages. Well, when I got back to work, I started examining my bumper more and realized that she pushed the trunk in enough to break the latch, so my trunk will not shut now. I have it held by a bungee cord right now. Anyway, i've spoken to her a few times, and the first few times she seemed like she was going to cooperate and fix the damage, (I got an estimate for $1,368.00) but recently she won't return my calls, and my brother's girlfriend saw her and she told her to tell me to "go ahead and sue me, I don't care."

I'm just wondering is there anything that I can do about this manner since I didn't file an accident report and/or claim it on my insurance.

I have the sheet of paper that she wrote all of her information down on, which coincidentally is a document from the place where she works.

You have a couple of options:
1. File a case in small claims court against her.
2. File a claim with your insurance and give them her information.
3. Get her insurance information and file a claim with them.

It doesn't really matter much that there's no accident report if the damage can easily be identified as resulting from a rear end collision. Check your insurance policy to make sure you can still file a claim and that they don't have a time limit that you needed to file within.
