After a motorcycle, while in the Emergency Room, the passengers blood was taken. They are now trying to charge the passenger with Aggravated Vehicular Manslaughter. Is the blood test admissiable or can the pre-trial motions have this information supressed. The driver of the motorcycle was killed and the passenger survived. It happened at around 2:30 am, on a not well lit road, and a couple of days later a witness, (a friend of the decests, their daughter now claims that the passenger was driving). The passenger has claimed they were not driving right from the start. The motorcycle is owned by the passenger.

HUH? why would you want the blood test surpressed?

My question is why would they need a blood sample from the passenger?
