What is the name of your state? What is the name of your state? Florida

Auto accident totalled 6mo. old 2003 car.
Was 100% NAF. MY insurance paid all but $5000 owed on loan. The at fault driver has $10,000 property damage/ liability coverage. Would it be possible to file a claim against this amount to "make me whole" again. If not , where does this money go? :confused:

If your insurance company paid you for the vehicle and you accepted their offer then you have been made whole. The value of the vehicle is not determined by what is owed on the loan. It is very common for someone to owe more on a vehicle than it is worth.

If you have not accepted the money you can return it and file suit against the other driver. Your insurance company will be trying to collect against the other driver's insurance and you probably signed a release giving your right of recovery over to them.
