My apartment complex has underground parking (as I live in the bitter cold of Minnesota). Returning home last night, I followed another car into the garage. The garage door came down on my car with so much force that it put a huge dent on the top. It eventually went back up but did cause extensive damage to my car. Under normal operation, the garage door remains open for 15 seconds which is enough time for 2-3 cars to enter. However, when I drove in, it was open for about 5 seconds before closing. As I see it, there are really two options to what could have happened. 1, the garage door malfunctioned or 2, the person who entered before me clicked on the close button to close the door earlier than the 15 seconds. My question, who is liable for the damage to my car? My main issue is that even if the person before me closed the door, shouldn't the apartment complex still be liable for not having a safety mechanism on the door? If the door had enough force to dent my car, it certainly had enough force to kill somebody walking underneath.
