I was in an accident on the 20th of January. I was changing lanes, and a girl hit me from behind. The damage to my vehicle was my left rear and the damage to the girl's vehicle was to her front right. The officer at the scene determined I was at fault and gave me an "unsafe lane change" citation. Upon reviewing the accident report (which was completed Feb. 8th and picked up today), the officer drew the diagram incorrectly. First, he didn't draw enough lanes (there were 5, he only drew 4) which is significant since the accident occurred in the 5th lane. Second, his diagram is inaccurate, as it depicts the damage to my vehicle on right and her damage on the left, which is the complete opposite. Is there anything I can do to contest the inaccuracy? Perhaps get it thrown out of court? |

A: Did the incorrect drawing make you not liable for the accident?

(the actual diagram is much larger, with more space between me and her.)
There is actually another lane, lane #5, to the far right, that he did not draw, and that is the lane I changed into.
The collision he draws is wrong, as my damage is on my right rear and hers is on her right front.
So, if he says she was in the 4th lane, and I was actually in the 5th, then doesn't that say that the 5th lane was clear, and I did not perform an unsafe lane change? |

By all means show this to the judge.
However, based solely on the facts you present and on your diagram, you pulled in front of #2 and thus performed an unsafe lane change.
Just my opinion...I thought OJ was guilty.
