What is the name of your state? Ohio
I was rear ended while i was driving my 01 ford taurus with less than 14000 miles and less than 1 yr old approx damage was 6000 dollars. i was told by the adjustor they would not total the veh but would fix it. i had the veh appraised for trade in value and was told since there was frame damage the carfax report would show severe damage thus drastically reducing the valu of my veh to approx $7000 and i still owe $16000 on the veh. since the accident was not my fault am i entiled to recoup the loss of value to my veh?
and how do i pursue this? thank you J. Shea

Who says the frame is damaged??
What did the insurance adjuster say when you showed the WRITTEN statement of frame damage??

The insurance adjustors (his and my insurance co) both listed frame damage on their estimates (it took 7000 lbs of force to straighten the frame)

Okay, we now know that there was frame damage.... but it was repaired. And since it was repaired, you have no claim as to the repairs. But you may have a claim as to what is called "diminished value". Simply, you are claiming that due to the repaired damage, your car is worth less than it was prior to the accident.

The success in 'winning' that claim depends on many factors, including your state, your insurance company and the specifics of the 'loss'.
