What is the name of your state?Louisiana-If a passenger in a vehicle (driver at fault) decides to get an attorney (to settle an auto accident case)does the attorney actually file a suit (in clerk of courts office) or does the attorney simply work with the insurance adjuster to settle the claim. Or- does the attorney simply make their demands to the insurance adjuster, stating injuries and requesting an amount to settle case???

All the ways you mentioned can be used by an attorney to settle the claim. It all depends on the attorney and how agreeable the insurance company is when is comes time to handing out the greenbacks. If none of those way work, the driver of the vehicle is sued.
