My wife had an accident two years ago this winter. The roads were iced and when coming to a stop traction broke and she slid into the car in front of her. This was probably around 3-5 mph. Both parties exchanged info and went on there way. Now two years later the claim to our insurance company is still open and they have a personal attorney and want to sue us also. These people live in our neighborhood and I frequently see them around. The person that was in the accident is claiming injury, but I see her doing yard work, grocery shopping ect. Legally can I take some pictures to submit to the insurance company for their review? I honestly believe that there is some fraud going on here.

| | | When and if you are sued, turn everything over to your insurance company/agent. They will provide legal counsel up to your policy limits.

Did YOU want this person's life to just come to a STOP! It's not up to YOU to disprove his/her injuries. Leave this up to your representation!
YOU have no idea what this person did/does feel like either BEFORE, DURING, or AFTER doing any physical activities. For all YOU know, he/she is on medicine, pain meds, etc., just to get through daily chores. |

| | | Agreed. Don't worry about it, this is why you have insurance. If they need anything from you other then your initial accident report (depositions, etc) they'll let you know, otherwise let them handle it. |

injuries don't always occur the day of the accident. They also are different for every single person. Just because the other party is not laying in an ER bed for 2 years doesn't mean they don't have a significant amount of pain that affects them either at work or home.
And, like you said, there could be an element of fraud here. Most people think its entirely okay to inflate or exaggerate an insurance claim, but good luck proving fraud. If the other party treats they get a settlement, if they treat the doctors get paid, and if they treat the lawyers get paid too. Why would anyone stop treating?
Basically, you were found at fault for an accident that involved an injury, this is what happens. Just let your insurance company handle it and have them keep you informed on the status of settlement discussions. They will also provide legal defense for you if you are sued. | |
