auto accident


State of Illinois****************************.

I got into a car accident on Dec 5th 2008. The man that hit me gave the police officer a Allstate insurance card. I Have Allstate also, but when I called Allstate they told me that the other drives insurance was a canceled policy. I only had Liability insurance, so I had to claim my accident under uninsured motorist. Two days later the other driver reinstated his insurance with Allstate. I had to wait until March until Allstate did some investigating on the accident and they said I was 10% at fault for the accident because if I didn't get into the right hand lane the other driver would have hit me. So now I'm still getting my car looked at and fixed. I just got a call from Allstate and they are not covering my brand new tires that I put on in April, that I had rotated religiously, because they said that they called where I had them put on, never gave them my name, but only went by the tread on the tire, and they told Allstate I NEVER had the tires rotated! I have proof I did. I had new brakes put on in Oct, and it doesn't take much for the rotors to get damaged. The car needed a front end alignment and it had a bend strut and I was waiting for a check from Allstate, but the insurance adjuster said that I should have taken care of the alignment and the strut before I took care of the smashed door, so they are not paying for my tires or the brakes. How was I supposed to know that? I have never gotten into a car accident before! I am so mad! I feel Allstate is punishing me for not having full coverage because of the statement she made to me over the phone about me not having full coverage. Is there anyway to get Allstate to pay for my tires and brakes? Can I make sure that When I take the other guy to court I can make him pay for all of the damage? I really need some advice! HELP!!!!What is the name of your state (only U.S. law)?
