Auto Accident 5 days before wedding


What is the name of your state? Indiana

5 days prior to my wedding, September 18, 2004, I was rear ended on my way to work. The person hit my car so hard that it pushed it under the SUV in front of me, deployed my airbags and I blacked out. I sustained minor injuries, including a sore neck, bruising, and two missed days of work plus the inability to work on my wedding.

The person who rear-ended me did not contact her insurance for 2 full days. Which by then, I had to go personally rent a car in my name so that I could go back to work.

They called on Friday and offered me a payoff on my car, and the only good thing I can say about that is Thank God I had gap insurance. They then told me that I had the rental until Wednesday. I explained that I would be in Florida on my honeymoon and she told me that they weren’t going to pay for my rental for my honeymoon. Well, we had planned on driving my car. My husband and I paid for the wedding ourselves which left us with very little money. We had already made reservations for a time resort in Orlando, FL and had already paid for our room. So we had to call and cancel our reservation since we couldn’t pay for the rental plus I had to go car shopping. Unfortunately the resort would not refund our money so I’m out that too.

What I want to know is in additional to physical pain and suffering can you be compensated for mental pain and suffering?

If all you wanted to know was if you could be compensated for mental pain and suffering why the long story about the honeymoon?

The answer to your question is up to the judge. You either need to have your insurance company file suit or you do so against the other driver. Then you'll get an answer.

I do that so you'll either be shocked back to reality or so damn mad you'll take action.

I contacted an Attorney 2 days after the accident because I was getting more pissed for every minute that she didn't call her insurance. They said that if my neck was still hurting after my honeymoon to go back to the Dr.'s. It has now been 2 weeks and I'm still aching. I need to try to get into my Dr.'s office.

Is there a time frame in which you have to have a second follow-up done for it to be covered by her insurance?

That depends on the insurance carrier and your attorney and the courts. Just continue following your attorney's advice and specifically, let them deal with the insurance company.

At this point, your only concern is health.

Is it legal for the auto insurance company that is paying off my car not to provide me or my Gap Insurance Provider an auto valuation statement? I called yesterday and they were rude as usual and said that they don’t send those out to anyone and that they can talk to her supervisor if they wish. This adjuster is the rudest person I’ve EVER had to deal with in my life.
