| | | | auto accident My husband and I were involved in an auto accident and were uninsured at the time. Unintinionally but uninsured, It happened on feb 22nd 2001, we were making a left hand turn and the other driver was going straight, we had almost completed our turn when we were hit in the rear panel . This intersection does have a turn signal but I cant rember if it was on or not. My husband was driving and had slowed down to make the turn and then we wwere hit. We were Pushed into a parked vehicle. The insurance company of the lady who hit us did not pursue it but the parked car guy did . We went to court and the judge found us 100 percent at fault. Decided not to fight it and try to get it behind us but now the other insurance company says that they already paid her claim and now want to be reimbursed. Should I wait till they take us to court, i dont think its fair, our car was also damaged why do we have to pay hers his and ours when she was involved as well..This happened in minnesota. |

| | | | Uninsured? How does being uninsured, unintentional? In WA state that automatically makes you 100% at fault no matter what. Maybe Minnisota is the same. Personally, I am way too paranoid to ever drive without insurance. Murphys Law always would involve me in an accident the moment I drove onto the road. I would say you probably would end up paying and it is either now or later and if you wait until they take you to court, you may end up paying Court costs as well. But only a Lawyer could tell you for sure. Good Luck...and maybe there is a lesson here. |

But, you were turning left, which means you carry some comparative neglagence. What you have on your side is that you had "control of the intersection" and by them hitting you in the rear quarterpanel they are between 50 & 75% at-fault.
You may be better off trying to negotiate before going to court, since legal fees won't be factored into the settlement.
To fnyrascal: please educate me based on the following scenario:
I am uninsured, driving my uninsured car northbound in the outside northbound lane on a divided four lane highway, when an insured driver in his insured car traveling south in the outside southbound lane going 40 miles over the posted speed limit crosses over the inside southbound lane, the medien and the inside northbound lane and into the outside northbound lane and hits me head on. In Washington State, who's the at-fault-driver? |

| | | | My son and I had this same debate this morning over who is at fault the uninsured or the party causing the accident. My son told me that the police told him that the person with no ins. is 100% at fault.
I still disagree and im going to check this out with Sec. Of State.

| | | | unintenional lapse in coverage How could it be unitional lapse, easy It was a brand new 2001 full size montero..We were paid in full for the year on our trade in, so we got a credit, when it came time for us to pay the new year somehow we never were notified we use an independant , who we've used for yaers who just thought we were late and never sent us the xl notice. I think maybe he was at fault partially, but bottom line my responsibilty. Anyways thanks for the info I realy appreciate it, I think I need to consult with a lawyer but thanks anyways..By the way 100 percent at fault makes me, us resposible for ours 5,000 his 7,300 hers 6,500. I can't believe shes not responsible at all not just because of the money. She hit us, We had almost completed our turn when she hit us in the back or rear of our truck.Had it been head on , maybe thats different. I dont think she was paying attention.. thanks for allowing me to vent.. |

| | | | My son is wrong!!!! I called the Illinois state police and talked to sergant.
He told me that the person causing the accident is liable for damages and that not having mandatory ins. coverage is a seperate issue. |

If the judge found you totally at fault then what reason did he give?? Perhaps you were in some way the negligant driver.
What did the police give you a ticket for? On what charge were you in court? If you did not get an attorney to represent yourself then your stupid and deserve to pay.What was other driver ticketed for? | |
