My wife was involved in an auto accident in which the other driver made an illegal U-turn in front of her. The other driver was given two tickets and their insurance company has admitted blame.
My wife was traveling at 50 mph in our 2000 Honda Accord and signifant damage occured. The damage is so significant, that the body shop indicated it was a 50/50 chance as to being totaled. It appears that they now want to fix the car rather than total it. I would rather have the vehicle totaled since I do not want to drive a car that just sustained that level of damage. It obviously would have lost some structural integrety. Can I fight this?
Secondly, my wife is now having consistent back pain. Beyond medical costs, what is typical compensation for pain and suffering?
Any comments would be appreciated.
