Auto Accident Info and Defective Product Liability


Houston, Texas 12/07/01
Head-On Collision w/ Uninsured Drunk Motorist. He Fell Asleep and crossed over into our lane of Traffic and Hit us . Totaled Our Truck. No Word as yet from Insurance as to Estimate or Settlement on Price to replace.
Airbags did not Deploy in 1999 Dodge Ram 1500 Truck
Collision was approx. 35mph -45mph, most damage resulted to Left front all the way across to right center of Truck , with damage reaching back to front of tire well.
My first Question is why the Airbags did not deploy?
Second Can I recover anything from other Driver if he is not insured nor has any assets worth mentioning.
We are claiming under Uninsured of our own Policy.
Still wanting to contact Attorneys to ask why there has been no Money released to us for Medical Bills, Finally received a rental Car , once the Insurance decided to file under Uninsured.
I want to know about my Injuries as well and a Passenger?
Both of us covered by Policy , but we have different injuries?
What is the Possible amount to recover in these circumstances?
(Pain and Suffering, Lack of Income, Lack of Transportation,Nightmares,Inconvenience of this whole thing!!
Police Report Clearly States other Driver Intoxicated, caused Accident by Crossing over into Our Lane of Traffic and hitting us Head-On. He also has Numerous warrents for -DWI, Suspened License,No Insurance......Any and All questions answered will be appreciated.

Can't answer your insurance questions, but my sister was hit head on, similar situation and her airbags failed to deploy. The guy crossed the lane and hit her head on, but the original point of impact was the front driver side. The truck actually rolled three times and was pushed down the street before stopping, so it's a complete loss. The explanation that was given to her as to why the airbags were't deployed was (at least in her truck) that there is a sensor on each side of the front end, roughly by the headlights. In order for the airbags to deploy, both sensors have to be triggered at approximately the same time or nothing happens. They said that was to prevent them from going off if you hit, say a trash can, where it would be more dangerous to have the airbags go off and startle you or even hurt you if you're petite. I can't assume, but perhaps the passenger side front damage was not due to the original impact, rather the after-results of the collision? So maybe you're lucky they didn't go off. At least in my sister's case, they said it was lucky they didn't go off because they probably would have done more harm than good.

But if you have questions for your attorney, why don't you ask? (Or if you don't have one, why not?!) That's what you're paying for! Even if they feel like stupid questions, you're the layperson and they're educated and being paid for this.
