auto accident involving death


What is the name of your state? West Virginia. My nephew was killed in an auto accident involving only his vehicle. My nephew was driving with two passengers in the vehicle. He was driving on a country one lane road, the road conditions were wet from rain, it was foggy, and alcohol was another factor. It seems he got the vehicle too far over the edge of the road, sideswiping a large oak tree and the vehicle went over and rolled down the embankment approx. 130 feet. The driver was thrown from the vehicle and killed, the other two survived with no visable injuries. The vehicle was insured with "liability" only. Question, with liability insurance and the contributing factors that the owner/driver was at fault will the insurance company pay any compensation on the part of the owner/driver who was killed?

no. liability insurance is to protect the owner/driver from claims made against him for his at fault accidents were people are injured. The passengers can file claims against his insurance policy if they were injured.

your nephew's estate cant make a claim on his auto insurance.
