Two years ago this past November I was involved in an auto accident. Police reports stated that the other driver was at fault and she was ticketed. I was treated at the hospital for head and knee injuries. I later recieved treatment for neck and back injuries. I was wondering if it is too late for me to take legal action. Also I was just served with papers by the passenger of the other vehicle involved. If it is clear that the accident was the other drivers fault can I counter sue the passenger for suing me and causing me more aggrivation, added stress and possibly losing wages due to her suite?

It is probably too late for you to sue as the statute of limitations expired 2 years after the accident. But feel free to consult a lawyer to be sure.

Report the lawsuit against YOU to your insurance company IMMEDIATELY. They will take care of your defense and since you were not at fault, will probably get your name taken off the suit. The passenger probably just named everyone involved in the accident.
