| I am in California. 18 days ago my parked vehicle (out of gas) was rear ended by a drunk driver, who then fled the scene. The driver was arrested, but her insurance company has not yet accepted liability, pending investigation. What I am asking for is repair of my vehicle, towing that I paid out of pocket, the replacement of my child restraints per the manufacturers advice, and loss of use of my vehicle. I have not gotten a rental during this time and my car is not drivable. My insurance company tells me that these are all reasonable requests that they would honor if it were their claim. My question is, are these things owed to me by law, or is it up to the insurance companies policy? |
