auto accident, need help!!!


My Name is Santiago . My case took place on july 9 2001. A friend that was living in an appartment next by me borrowed my car, and got in an accident with another car. My insurance had expired 5 days previous to the accident. it was his fault because he didn't stop in an "stop sign". the other person's insurance company is sending me the claim so I pay the other's car damages and medical expenses. the claim that the insurance company is sending me is of $6,000. I don't have the money to pay that off, and since I wasn't driving I want to know what do I need to do in order to have this guy ( the one that was driving my car) be responsible for this accident. He doesn't want to know anything about this. I tried to talk to him, but he is refusing to do something about it.
I'm an international student, and I don't have money to pay this. I'm just barely paying my own education.
The laywer from the insurance company called me to let me know about my driving priviledges, and he explained to me the procedure. I told him i don't have the money, and I wasn't going to be able to pay that money.
can you tell me what can I do about this.
In two weeks I'm going back to my country, and I don't what's going on with this. I really don't have the money to pay it, and I don't have any assets. If I don't have money or anything to pay it. what can I do? is there any way that I can get out from this problem?

What to do!!


I have received your E mail on this question so I hope your listning. All you can do is talk to the insurance co. and explain your situation and try to work out a payment plan with them.
They may agree not to sue you if you will agree to some payment plan. You may have to get a part time job to pay this bill.
And you need to make sure the 6,000 is a complete and final settlement with them for all damages both for medical bills and property damage. Get this in writing before any payment is made.
Depending on the terms of your student visa you might have to drop out of school for some time to work and pay this bill off.
You may have to get some approval to do this so check that out.
Also you can check with the Argentine Embassy to see what advice or help they can provide. I hope I have provided you with additional advice to that already provided by others.
