auto accident nightmare


texas
accident on aug 8th of 02. the police report was inaccurate and incomplete.
other party's insurance demanded payment arrangements be made( by letter) before the total amount of damages were known
i declined . second letter sent had the total amount of charges owed (dollar amount only) no description of charges. i then requested an itemized copy of the charges, received nothing.
six months later, i start receiving phone calls at work from a represenative for the ins. co. this has caused a great deal of problems for me at work. the latest message left with our receptionist stated, ( tell him it's in regaurd to his driving privilage)
does that constitute third party disclosure?
and can they legally suspend my drivers license if i contest certain items that they are charging to me?

If you didnt have insurance at the time of the accident, i'm surprised you still have a valid drivers license. I guess they havent told texas motor vehicles yet.

noone said he didn't have insurance.

and they can't touch your license if you decide to fight the charges.

why don't you give us more info?

how accident happened (in detail)
what the police report said
what your insurance/lawyer is saying

etc.

thankyou for your response. i was driving in the right lane of a two lane service rd. there was another car in the left lane about a car length in front of me.as i approached the off ramp area, i looked to my left to see if anyone was exiting, seen nothingcoming. as i turned my attention back to the front, the carin the left lane,next to me slammed on his brakes and veered hard to the leftto avoid hitting the suv that had exited the freeway and then made a hard right turn to go into a gas station.
as the car in the left lane skidded to the left, the suv was then straddled the entire serv rd. when the carthird car started to skid, the tire noise scared the elderly woman driving the suv,so she slammed on her brakes,stopping,as i said, in the middle of the road. i slammed on my brakes and steered to the left to try to avoid the accident. my vehicle struck the rear pass side behind the wheel and sent the suv into a spin.this caused a flat tire on the front of the suv.the tire was changed and the suv was driven approx 40 miles to her home. my vehicle was towed due to severe
damage. the police report sited failure to yeild and driver inattention. the diagram given by the officer, showed my vehicle hitting the suv as it exited the freeway, which was wrong. and there was no mention of the third vehicle. the ins adjuster said he had no reason to beleive that there was a third car at first, then,on a latter phone conv , he stated that he had a whitness,
who said that the third car and i were racing on the serv rd. major contradiction i think. my insurance co had increased my rates at the begining of aug. due to a speeding ticket, which i never received. so i had not made a pymnt,waiting for the agent to sort out the prob. when they were informed of the accident ,they said the my policy was expired. i feel as though my back is against the wall.

lesson #1 - if a conflict arises with your insurance, continue to pay it and get a refund later. the one thing you do not want to do is stop payment - it gives them the right to cancel your policy and there is NOTHING!! you can do about it.

i don't understand the accident.. two lane road, you were in the right lane. why did you look to your left to see if anyone is exiting? you said the car next to you slammed the brakes and veered to the left... where to the left ? wasn't it already in the left lane?

if you could draw the picture you could clear up a lot of things, but from what i see right now you are at fault for rear ending her because you did not keep enough distance to bring your vehicle to a stop in case of an emergency.

hopefully i am missing somethingthat would help prove that you're not at fault...

so yeah, a picture would be nice...

First no one forgets about a speeding ticket, then you compound the screwup by not paying your full auto insurance, so they cancelled it.

Then you get into an accident and they want you to pay for it since you didnt have insurance at the time.

Maybe you should spend less time with the gameboy or x box and Do not turn on your TV set on weekends...yes give up sports, until you learn how to use a computer and be able to check and pay all your bills on line and immidiately if needed.

You will also need a credit card thats not at its limit so you can call the nice people at the auto place, and pay it in less then 15 minutes.

Yes my friend your back is against the wall. Time to sell everything you own, and pay the bill, and live cheaply get a second job, and all will be fine in a few years. Maybe move close to your job so you can walk, or ride a bike, or take a bus.
