Auto Accident with no police report


Texas

I was in a car accident where I was traveling on a main road. A person turned onto the main road from a side street with a stop sign and hit my car. We went to a parking lot and exchanged information. The police came but no report was filed. When I call the person's insurance they are denying to pay because the other driver lied and said we were both traveling on the main road and I switched lanes into her. There are no witnesses so what can i do. Damages to my vehicle are 900$ and I have a 1000 deductible. I have the persons information including.

Should I try to go through my insurance, and i so will I get my detuctable back if they determine it was her fault.

Should I take the person to small claims court and sue her for the damages.

Higher a lawyer and sue the insuance company.

Contact the person directly and try to work it out.

pay to get my car fixed

or is there another option I haven't mentioned.

Just let your insurance company handle it. That's why you pay them.

so Just pay


Will I have to pay the deductible if it wasn't my fault?

If so there's no point cause the damages are 950 and the deductible is 1000

File a claim with the other person's insurance. If you have to sue, remember you sue the DRIVER not the insurance company.

No. If it's not your fault the other person's insurance should pay for it all.
