auto accident....pre existing condition.

Happy Holidays!!! I was involved in an auto accident 12-18, 25 mph, she hit my drivers side door. I have had surgery on my back in april , and just reached my MMI, maximum medical improvement, (70%) in november. Iwas injured and still have alot of pain. My DR. has scheduled an MRI . Now my question is , Who is responsible????? Is it considered a pre existing condition????? Please help!

By MMI i am assuming that you mean major medical insurance and 70% is what the major medical has paid to the provider. If so you should be liable to pay the remaining 30% to the provider. unless you have a type of insurance with the participating doctor (and went to a participating doctor) that usually absorbs the unpaid cost and only accepts what the insurance pays them. as for preexitsing conditions they vary from insurance co to insurance co. you are usually ok if you have had your insurance for a while. usually there is some time frame that you have had to have the insurance for so that they will conver pre-existing conditions. I am not sure how hmo's work with this though if you have an hmo.
the best thing that you can do is call your insurance carrier and ask them. make sure you write down your questions before calling and once calling get the reps name and a direct telephone number incase you are disconnected so that you do not have to change to different people telling you different things.
