Auto Accident Question


South Dakota - Two months ago I was involved in an auto accident. I rear-ended a gentleman. There was no damage that could be seen on his vehicle at the time and no major damage to mine. We both agreed that we would not need to file a report with the local authorities. We did call his insurance company and report the accident immediately. After exchanging information we agreed that he would have his vehicle looked at to ensure that there was no damage. If there was repairs that needed to be done, the gentleman assured me he would contact me the following week. I did an interview by phone with his insurance agency the following week, and the insurance agency informed me that if there was anything else needed by me that they would be in contact. I heard nothing from the owner of the other vehicle or his insurance agency again. That is until yesterday. I was contacted by the owner of the vehicle I hit, and was informed that he had finally gotten around to getting an estimate on the "damage" and it came out to be $550. He then stated that he did not think that this amount was fair, and that he had found someone to fix the damage for $100. I asked for a copy of the estimate he was given for the $550. The gentleman continued to apologize for taking so long to get back to me on this but agreed to send me a copy of the estimate by email. When I received the estimate, the date was from the DAY AFTER THE ACCIDENT OCCURRED...2 months ago. Now this gentleman is asking me to pay $100 to settle it directly to him! I said that I would need something in writing stating that this would be considered full payment and no other payment was needed. He said he'd get that to me after he received the $100. Do I really have to pay this guy? Is there a certain time frame he has to notify me of damage that needs repaired?

Hi, I take your post to mean you haven't contacted YOUR insurance company? I don't have answers about if you pay him the $100 and you would be done if you received something to the effect that the $100 is Payment In Full for the damage. I also don't know if you should have contacted the police. I do think that 2 months is a long time for anybody to have given you a good faith estimate but it doesn't sound illegal.

I realize if you contact your insurance you could have your premium increased, at the minimum, but it sounds like the best option right now.
