Auto Accident Settlement


Pennsylvania
I was in an auto accident two years ago and I was the passenger in the car that was rear ended. Well come to find out the car that I was in had no insurance and my medical bills totalled to 10,000. However the woman who was fully at fault did have insurance and since the car I was in wasn't insured the woman at fault should to pick up the tab. But my lawyer is trying to tell me that this is an out of pocket cost for me. Is this true?

I'm not a lawyer, so there may be some reason that your lawyer is telling you that your medical expenses are not covered by the at-fault driver's insurance that I would be unaware of, but what you are being told doesn't make sense to me.

Was the driver of the car in which you were riding injured, if so who paid for the driver's medical costs?
Any other passengers in the car in which you were riding, if so who paid for their medical expenses?

I would think that if the answer to the first part of either question above is "yes" and the answer to the second part of either question above is "at-fault driver's insurance company", it would seem to lend a good deal of weight to your argument that the at-fault driver's insurance should pay your costs as well.

What was the your lawyer's explanation for the at-fault driver's insurance not paying your damages?

If this has no reasonable explanation, I think that I would consult another lawyer. Actually, no matter the explanation, I think that I would consult another lawyer regarding an attempt recover damages from the driver of your car or the driver of the at-fault car.

As stated above, I'm not a lawyer, so this may all be correct per the law, but just from a common sense point of view ... -
