my daughter was in car accident sept 2002. she concurred $13000 in medical cost and 5 yr old granddaughter was killed in accident. no compensation has been paid as of yet. accident report says she was at fault in pulling into oncoming traffic. collision vehicle was 3rd vehicle. according to report 1st vehicle pulled into median to turn 2nd vehicle saw daughter's car pulling out veered right to avoid 3rd vehicle moved into passing lane did not see according to driver and impact was instant. lawyer is trying to make case on son-in-laws part to sue for loss by saying 3rd vehicle driver negligent by driving to close. no insurance benefits have been paid or compensations. questions: statute of limitations ? also attorney has said on 3 other occasions case was set to go to trial and dates have come and went last incident was to take place in feb of 2004 but just received letter stating 3rd vehicle driver is just now going to give deposition in march 2004 and my daughter and son-in-law gave theirs in april 2003. should we seek another attorney because it seems they are getting the run around
