auto accident and workers comp


What is the name of your state? nj i was working as a nanny it had just started snowing and a lady came through an intersecting street hit the back drivers tire spun us around we hit the curb she was working for a local cleaning company she claimed fault at the scene even though there were no tickets given. the accident was 2 months ago i have tramatic cervical and lumbar strain i have been on three medications for two months workers comp through my boss has been covering my medical but i am worried that it may not last long i am not from nj i don't know the laws i cannot perform all of my duties at work and by the time i am done i am hurting so badly i take my pain pills and muscle relaxers and go to bed i have spent the last two months in bad and the doctors just tell me wait i am in therapy 3 times a week with very little improvement so far and i don't know what to do. do i need a lawyer please help.

yes i feel that i need a lawyer i am just conserned because my boss is being some what helpful and she is lawyer herself and i am nervous what will happen if i get a lawyer i don't want any more problems than i already have and she is trying to say that since i am very active outside of work that she thinks my injuries could be from something outside of the auto accident

My response:

And, why do you think your employer, the lawyer, is saying, "she thinks my injuries could be from something outside of the auto accident"?

Well, that's because there's a "conflict of interest"; i.e., she's being "somewhat helpful" (as an attorney) but, at the same time, she's also your "employer" looking at the potential of a Worker's Compensation Claim, and could be "on the hook" to you for payment of damages. That's the conflict.

You need your own, separate, independent, Personal Injury attorney, to make a claim against the person who collided into you, AND you need your own, separate, Worker's Compensation attorney.

Say, "Thank you" to your employer/attorney for her help, but her help won't be needed any longer with this matter. And that's because you have NEW attorneys helping you.

Go retain new attorneys. They'll take your claims on a "contingency" basis.
