Hi , my left arm was injured when a car hit my home on 7-28 99, the ins., co, said my auto ins was liable for my medical. I went to a spcialist and he said i had a ruptured bicept and a torn ligament and to keep on using it but not to put any strain or not to lift anthing heavy until it healed 6-8 month's, his assistant told me any more damage and it would need surgery , they never took x-ray's or said anthing about therapy, it's 1-3-01 and is the same as it was on a 1-10 scale it's about a 2 to my right arm and it's not going to heal anymore than it has. Can i get compansated for this? can the doctor be liable for anything? i live on a fixed income and barly get by now, my ins, has a 300 deductable. Do i have to live with this, I kmow if i wasn't just joe-blow and this would be efecting my job,more would have been done, his attitude was to just get me on my way, iv'e seen it before. Thank You
 


Two things:

1.) Muscles and tendons don't show up on x-rays.

2.) You missed the red writing at the top of the screen that tells you include your state on the post.

In ressponse, i live in Michigan, how do doctor's know when surgery is nessasary ? MRI- CAT scan will not show anything,if it's not any better by now then just letting it heal on it's own evidently was not the solution
 
You have several options. The best one is to consult an attorney who specializes in medical malpractice. Some if not most will give a free consultation. What you should have done sooner was find out if the person who hit your house had Bodily Injury Liability coverage. You still have time. Any settlement would at least cover your out-of-pocket expenses (deductable and such). The last option is to get a second opinion on the injury. Try all of these.

I am not a doctor. Without offering a medical opinion I can tell you from experience that the "extent" of any ligament damage has to determined by inserting a scope to view the damage. This is considered surgery and thus is expensive. Torn muscles heal better when immobilized. If you do too much too soon then the muscle may heal improperly or too slowly.

Bottom line: Get a 2nd opinion and see an attorney.
