Auto Claim


What is the name of your state? FL
I WAS REARENDED FEBRUARY 19. 2006. THE OTHER PERSON WAS CHARGED OF COURSE. HIS INSURANCE HAS BEEN VERY SLOW.. ADJUSTER FINALLY SAID HE WILL NOT REPAIR MY VEHICLE, AND TOTALED IT. IT IS DRIVABLE. ONLY REAREND DAMAGE AND BACK WINDOW KNOCKED OUT. DOES NOT WANT TO PAY ENOUGH TO BE ABLE TO EVEN FIND A VEHICLE ON THE MARKET OR REPAIR. SO I FEEL I AM LOSING ALL AROUND. CAR WAS IN EXCELLENT CONDITION. OLDER CAR, HIGH MILEAGE, BUT A TOWING PACKAGE AND WE USE THIS VEHICLE FOR PULLING HORSES, ETC. WANTS TO GIVE US $1300.00. CANNOT FIND A COMPARABLE VEHICLE FOR THAT.
ONLY THING I COULD FIND ON WEB IS INSURANCE COMMISSIONER FOR STATE OF WASHINGTON, WHICH STATES THAT ACTUAL CASH VALUE IS DEFINED AS TO REPLACE YOUR VEHICLE WITH A COMPARABLE MAKE AND MODEL IN SAME OR BETTER CONDITION. I HAVE SINCE FAXED ADJUSTER THIS INFO AND HAD NO RESPONSE. SHOULD WE JUST TAKE THE $1300.00 AND FORGET IT? I CANNOT FIX THE VEHICLE FOR THAT PER THEIR OWN ADJUSTOR.What is the name of your state?

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Take the $1300 and buy it back from the other insurance company for salvage value (ask about this option).

You could look up the blue book value of your car and see if you can get the insurance company to come closer to that figure. Might not work, but worth a shot.

I don't know about Florida.. but in California, if the cost to repair the damage to your car EXCEEDS the fair value for the car (before the damage) the insurance company will declare your car totaled.. It has NOTHING to do with whether or not the car CAN be repaired, but whether or not it makes financial sense to the insurance company to pay for the repair. California also uses comparable values to determine how much the vehicle is worth..

Why don't you try countering the adjusters offer?? Go to Edmunds.com and use their fair market calculator to determine if what he is offering is on par with the vehicles value.. I did this for an accident I had 10 years ago, and was able to up my settlement a little.. But if the car is older, it's probably not worth as much as you would like it to be worth..

What someone else here suggested (buying back for salavage cost) is a viable option.. However, you will not be able to get the same coverages you had before on the car.. Insurance companies won't cover salvage cars the same as non-salvage cars.. AND you have to be sure you can afford to repair the car. I hope it works out for you..
