i got into an accident and even though the police report states that it was the other driver's fault (he failed to yield right of way), the officer failed to take the name of the only witness to the accident. the insurance company claims that because the officer failed to get the name of the witness they are denying my claim to have my car fixed. if the police officer failed to do his duty, what can i do to get my car fixed? i live i texas.
 


A few options for you....

1. Let your own insurance company take care of your damage.
They will recover their money, as well as your
deductible.

2. Request to speak to the supervisor of adjuster who is
denying your claim. Ask them to review the facts of the
accident, as well as the police report. Let them know
that you are willing to pursue the matter in small
claims court, if necessary.

3. If all else fails, file in small claims court. Take
a couple of estimates, as well as a copy of the police
report with you. You will have a very good chance of
winning because the police report is in your favor.
