Two months ago i was in an auto accident. The only thing damaged in the accident was my car. I contacted the insurance company, and they sent an appriaser out. I was told that it needed wheel work, and body work. These of course had to bee done at two separate shops.

I had the wheel work done immediately, and paid for it out of my pocket. I was told that i would be reimbursed when the entire job was done. I took the car to a body shop, and had them look at it. They determined that there was much more damage than the inspector originally found.

I called the insurance company again, and told them the news. They said that if the estimate was true, then they would junk the car. They told me that their inspector would inspect the car and have his results in under 72 hours. It has since been two weeks. The insurance company has since been putting me off every time i call.

I did not have rental car coverage on the policy, but i have had to rent a car for the entirety of this ordeal.

My question is whether or not i would be able to press the insurance company to pay for all of the expenses i have incurred because of the initial faulty inspection, and the time waiting for the second inspection. These expenses would include all my rental car fee's, storage fee's, body shop diagnostic fee's, and of course the initial wheel work done by the first repair shop.

I want to write a letter to the company detailing all of these costs, and demanding a check.

Should i do this before i complain to the state insurance department?

Ok, you should send a letter, and possibly hire a lawyer to do a letter for you to the insurance company. Did you get the contact information for their appraiser?

I have not yet got the contact info for the appraiser. I was told by the insurance company that only the initial appraisal is subject to time constraints. Their second appraisal was called a supplement, even the the initial one was completely wrong.

I will look into getting a lawyer to write the letter. Am i justified in demanding compensation for the rental car, even if it was not covered by my policy?
