In Nov. 2000 I had just completed backing out of a parking space in a parking lot. I was then lightly bumped into from the rear by a lady in a 1/2 ton pickup. I proceeded to get out of my auto to check for any damage and noticed only a quarter sized spot of paint which had been scraped. Her pickup showed no damage whatsoever. She stated twice that she was ok but was otherwise loud and beligerant. She made no request to call the police, nor should she have. There were no witnesses in the area. End of story? Nope. A month later she files with her insurance company , State Farm, a claim for $3050 dollars, which they pay!
State Farm writes to me wanting to be reimbursed. I immediately protested this action and filed a fraud report with the Texas Insurance Commission. State Farm then requested to examine my auto for the first time and their own examiners could not even locate a crack in my plastic Ford Escort bumper. They were incredulous that I had supposedly been involved in an "accident", and even more so that the other party had claimed over $3000 damage to a 1/2 ton pickup. Case closed? Nope. They are still sending me bills for the total fraudulant amount. I am unsure as to what to do next. I do know I will not give up one nickle toward this outragous fraudulant claim without a heck of a fight. Any knowledgable suggestions? Thanks a bunch.

My response:

Well, what you should have done was to go to the police station and made a report, then you should have taken pictures, then you should have had an estimate or two written. And then, you should have reported this all to your own insurance company.

Now, it's too late for all that.

What you're going to have to do now is wait to be sued by her insurance company, and then cross-complain against her for indemnity.
