Automobile Accident Advice In Wierd Situation

What is the name of your state? California

Sorry long story, but stuck in a situation. I have hired a lawyer, but need legal advice from various people.

I was basically involved in 2 accidents in one day. The first accident occurred with me getting rear ended. I was at a red light getting ready to make a right turn when the light had just turn green and I had to wait for a pedestrian. My car was position halfway during the turn but still in the right lane. I was struck from behind in the left side of my bumper as the vehicle that hit me tried to swerve out of the way, but failed to do so. We both pulled over to the side, and I sort of knew the person. No damage was done to his car, but to mines. We exchanged information, but no police was called. We continued to talk and he said we should be talking here so me and my friends decided to go to his house. At the accident there were 2 witnesses claiming it was his fault. He had a next door neighbor that worked at a body shop to take a look at my vehicle while at his house. He declared that I needed a new bumper but he wasn’t sure what it would cost so I had to go to a body shop to know for sure.

I went to my car and he and his neighbor hopped in my car as well. I insisted he take his car, but he said no it’s near here. I didn’t know what to do, but to drive to the body shop. The reason I refused is 1. He hit my car 2. I didn’t trust him much 3. I have a provisional license and can’t drive young people around. Now I’m at the body shop and we got the estimate. He looked at the estimate and knew he can get it cheaper because his friend can do it. I said I don’t really know so I have to go home and think about it. So while exiting the body shop I hit a trailer park clip, while reversing (those things that connects the trailer park to a device to a vehicle as transportation). As a result I pierced a hole into my rear bumper, which leaves the estimate still the same because I needed a new bumper anyways. I drove him and his friend home and got his numbers and everything.

That night I talked to him and he tells me personally that his name wasn’t on the insurance he hit me with. I got other estimates and informed him that I would only go to dealership to get my bumper replaced. He was mad that I was going through insurance, so he claims that while going to work today, he felt some back pains. And that he blamed the second accident in causing the back pain. Now he’s threatening to sue for injuries while in my car. On the other hand, I told my insurance company about the situation. I have also suffered back pain, but probably from the first accident because he was going more than 20 mph, while the second accident was about 3-4 mph. I am currently seeing a chiropractor and she tells me that I have serious injuries and would take 1-2 years of adjustments to get it be normal.

What I would like to know is what can be done, and what would be the results if I would go to court. Do I have a winning case that can result in getting my car fixed, paying only for chiropractor bills, for him not to receive anything because I don’t think a 3-4 mph accident can cause back pains, find out if he is faking it, and for my insurance not to go up.
