backed out of driveway


What is the name of your state New York

I backed out of my driveway late at night into a car parked behind my driveway. The car was parked in a tow away zone clearly marked along with a no parking sign. The police were called and a report was filled out along with a summons for parking in the no parking zone. Am I fully responsible? It was very dark and there were no street lights.

Civil courts do not determine fault the same way as a criminal court might. In CA you would likely be "at fault" in the collision report with a contributing factor being the illegally parked vehicle. But based on other conversations I have had with legal eagles here and elsewhere, a civil court and insurance companies would not likely see it the same way.

However, why didn't you look to see if there was anything or anyone behind you? Thank goodness it was not a child or a pedestrian!
