I am a college student that doesn't have much money. My dad just purchased a car for me. He tried to get it registered , but they would not accept the title because there was white-out on it. The name on the title is different from the guys name that sold it to us. He told us it was his step-father. The odometer says 98,000 miles, but I found a paper in the trunk that says it really has 258,000 miles. So I think he tampered with it. He also promised to replace the windshield. He won't return our phonecalls. Do I contact the police? Is there a cheap way to handle this? Please help me, I am getting very worried. I live in Texas.

My response:

You want to sue him in Small Claims Court for an amount up to the maximum jurisdictional limit. Here's why and what your Causes of Action should be:

First, the agreement is voidable on the grounds of tampered title, and that the person who sold the car to you did not have an ownership interest in the car in order to sell it to you. It's a little like selling your father's watch without your father's approval.

Anyway, your Causes of Action would be:

1. Breach of Contract;
2. Rescission;
3. Contractual Bad Faith; and,
4. Punitive damages.

Go get him!!
