in regards to my last post, i just discovered some new information. it seems that the officer who appeared on the scene did NOT list the accident as no fault. he has it listed as her fault with a "failure to yield"

does this change things, cuz it seems to me that it would....

It should be noted that "fault" as assigned by the police is NOT necessarily the "fault" assigned by a civil court or insurance companies. It is not uncommon for the police to make a determination of fault based upon the law and their investigation, and for insurance companies to determine fault based on whatever criteria THEY want to use.
