Biggie - leaving scene - civil suit


What is the name of your state? PA
Ok - Coming up a hill, a truck was on my side of the road going around an illegally parked car. I came over the crest, noticed the truck, veered to the right, into a shed. In the meantime, I hit the rear drivers side of his truck as he was trying to get back on his side of the road. Got scared, and I left. Long story short, pleaded guilty to careless driving and leaving the scene. My insurance company paid for my car (I was fully covered), however, neither of our insurance companies paid for his truck. So, he ended up civil suing me. I paid the bill for his truck, now his insurance company is suing both of us (yes, his own insurance company) - and the amount isn't specified on the lawsuit. It's pre-deposition where I have to answer a bunch of questions. Anyway, I got a letter in the mail a few months ago from his insurance company stating that they investigated the accident and feel it was my fault, so I have to reimburse the insurance companies lawyers $7,000 to cover the cost of investigating the accident. But, the lawsuit doesn't have an amount, so I'm afraid I'm also being sued for his medical costs (he went to the ER, got a bunch of tests - wasn't hurt - but he did get CAT scan, etc..,) So this lawsuit could be $50,000! Has anyone heard of a car insurance company suing you civilly? Isn't this what you buy car insurance for? Please help me out - I'm desperate!!!!!

You should have let your insurance know you were being sued, they would have provided counsel to defend you as well as pay the costs to fix his truck. This is what you have insurance for. Turn this into your insurance co. imediately. Also, the accident doesn't sound like it is your fault in the first place. I wouldn't have paid him anything.

I agree with Lynx, it doesn't sound like you were at fault here. What was the basis of your careless driving ticket? I don't understand what you were cited for beyond leaving the scene.

Regardless, turn it into your insurance company asap.
