Biker Totals Mailbox


What is the name of your state? Connecticut

Hello All:

My sister had the following situation today and I told her about this forum and all the great advice that has been provided to me. She asked me to post for her, so here it is:

Today, at her home in CT, she awoke from a nap to find that a bike rider had totaled her mailbox. The mailbox is relatively close to a busy two lane road, as are all the mailboxes on that road, per the Post Office, but not ON the road of course. It was located on the grassy area in front of her property. The biker was quite seriously injured and had to be airlifted (I think) to a hospital. A witness to the scene said he saw the whole thing as he was driving by in his car. Witness said he thought the biker was going tremendously fast as he (the witness) had to speed up to 45 miles per hour to pass him on the left (her house is at the bottom of a hill) and the biker hit the mailbox like "a ton of bricks," totally destroying the 4x4 post the mailbox was attached to.

Additional facts: Biker was not wearing a helmet. Cop at the scene commented to my sister that he had smelled alcohol on the biker's breath, which is apparently going into the police report.

So, to the question: Any thoughts as to whether this person has a strong legal basis for a lawsuit? Obviously you guys aren't mind-readers or fortune-tellers; I'm just looking for general comments or thoughts as my sister is worried about both the biker and her own liability.

If your sister didn't run out there and kick him in the head, I wouldn't worry about it a whole lot.
