My response:
The other person's lack of insurance has nothing to do with you, or whether or not you're negligent. Lack of insurance is a problem between the driver and the State. So, on top of the damages you'll be paying due to your negligence, you'll also be fined by State, and have your license suspended, for your failure to be insured. This will also happen to the other driver.
