Can Attorney Keep PIP from My Insurance??

What is the name of your state? Texas

THis is the first for me and filing a suit for non payment from the other insurance company if i had it all to do over and had to I would file for the PIP myself under my policy and collect that money first In the meanwhile the attorney we retained filed under my PIP and is merely sitting on that money is there anything i can do about it? This was a one car accident and my car was not involved at all..

Any input is greatly appreciated!
