Can I settle?


What is the name of your state? Texas

I was involved in an accident on Wednesday. I was the front car in a 3-car collision and received minor damage to my rear bumper. The accident is still under investigation and the driver at fault's insurance was through his employer.

I got a ticket at the site of the accident for expired registration and the claims adjuster appraised the damage at about $350. That barely covers my charges due to expired registration without getting my car fixed.

Would the employer of the driver at fault be apt to settle without me claiming with their insurance provider? Is there any way to recover the charges of me getting this ticket? If I were to call the employer, since I know who they are, would they be more likely to cut me a check for say, $400, versus me getting my car fixed by their insurance company?

Your ticket is the result of your conduct and is therefore not part of your damages.

Would companies generally settle for more so that I don't claim it through their insurance or would that not matter to them?

There is no reason for them to settle with you. The insurance company is already involved, or their adjuster wouldn't have seen your car to estimate the damages. No, they are not going to do what you are asking. Again, the expired registration is completely separate from the accident, and they are not going to even think about offering to pay it for you. You don't get "paid" for driving illegally.

The at fault person's ins. co. is only responsible for the damage to your car. Why would they be responsible for an expired registration that is your own fault?
