Can I sue the Driver?


What is the name of your state? TX,

My friend was driving the car while I was in the passenger seat. We were taking a left turn at the interestion in a residential area. The traffic light was all green ( protected yield). The other driver was driving too fast and hit us on the front corner. I was taken to the ER while the car was totaled. My insurance company paid 80% of my medical expense while I continue to pay 20% of the rest. The case is still on going in the court as to who is at fault. This happened 8 months before. Can I still sue the driver at fault?

I'm confused by your statement. If both cars had a green light, you're required to yield regardless of how fast the other car may have been going.

But to answer your actual question - yes, you can sue the at-fault driver.
In this case, it appears that the at-fault driver may very well be your friend.

I would suggest waiting to see who the court decides was at fault before deciding who to sue.

When did the accident happen? The statute of limitations in Texas is two years.

When you say it's going to court to decide who is at fault, what do you mean? Is your friend suing the other driver or vice versa?

What are your injuries from the accident?

Basically, you sue both drivers, they'll blame each other, and the court will sort it out.
