What is the name of your state? CA
I was involved in a accident. The other driver is unlicensed and has expired insurance. She does not own the vehicle involved with the collision. Based on the evidence and vehicle code merging to a vehicle in a intersection, i'm at fault since i T-boned her.
Their is no evidence, and proof to say she ran a red light I was traveling 35mph in a 40 Zone and she was traveling 40mph. I showed brake marks, and she didn't.
Can I go after the owner of the vehicle or her, because she should have never been on the road? She was cited for not being licensed. I'm a student, and it's cost me more then i could handle! THANKS!:(

She is not at fault merely for being unlicensed. One of you ran a red light, and without a witness, no one can prove which one of you it was. So no, I don't think you can win in small claims court.
