No possible way to answer your question without a complete description of what happened in the accident in something resembling proper english.

You can sue the party you believe caused the accident, or claim with his insurance company. Whether you will win depends on whether the other person was actually at fault. Which we can't tell without knowing what happened.

school bus causes accident

I do have a current drivers license. And my insurance is for liability only. The driver of the van was not wearing shoes and did not have her license in her posession. I assumed all parties involved had current insurance, as no tickets were issued to anyone.

The fact she didn't have her license in posession has no bearing on her liability.
The fact that she didn't have shoes has no bearing unless you are somehow going to argue that her bare feet caused the accident. It is, contrary to popular belief, legal to drive in all 50 states in bare feet. The only thing that comes close to a restriction is that you must wear shoes on a motorcycle in Alabama.

Yes you can claim agenst the at fault party,(as you see it) ant they will decide how fault would be distributed, the status of the license of either party is only an issue when getting a policy, or getting pulled over and ticketed.
