| Can victim's car insurance be used to claim in an accident? What is the name of your state? new york
My dear friend was in a car accident at no fault of his own. He was crossing the street when a limousine hit him.
He is now in hospital for three weeks with broken back, broken hip and other minor pains all over the body. And he has missed work since then and doubtfully he will recover to go back to work any time soon.
His medical insurance may or may not cover the hospital costs. More likely not. Meanwhile, the lawyer representing him is asking us for my friend's car insurance policy which he WAS NOT driving at the time (he was on foot). The lawyer's explanation was if by any chance the other party's insurance does not come up with enough money to pay for the hospital bills, then my friend's car insurance will be claimed.
Being new to all this, my friend is reluctant to give the insurance information away for fear of raising the premiums and all other issues we don't know now.
What do we do? Is that a standard procedure to use the victim's car insurance to cover the hospital costs? We are not even talking about the compensation for loss income. We just want to cover the hospital costs. What if he doesn't have a car and there is no insurance? What would be the alternative?
If anybody could, kindly advise us how to proceed. Thank you very much. |
