| Can we sue for increased insurance costs? NJ
Jane's kid beat that accident thing. (17 year old girl)
(Passenger grabbed steering wheel at 70MPH on Parkway and caused car to go out of control, totalling car, summons issued for careless driving, charges dropped, legally represented for $1000, won the case)
Her driver license abstract shows only 2 points.
Her Insurance Company has that, plus they are assessing her 5 point
internally for the accident, for just being involved (their own internal
ranking procedure).
Hence her notice of non-renewal.
Even though she is not 'officially' charged with any accident, and what
is what is, and now she will need to search for any company that will
provide coverage, is it not technically possible to sue the girl who
caused the accident for the increased costs which are to be expected for
the next 3 years? (Which realistically can be 4-10k/yr.)
I'm only thinking out loud, as if I too were in a similar situation, I
don't see how if I was absolved of all fault how I would then be
penalized for something I did not do.
Makes sense, but I was curious if there is any resolve. |
