car accident


What is the name of your state? What is the name of your state? Georgia
Rear ended on 9/27/02. Others drivers Insurance(other driver at fault) has repaired my auto and paid doctor bills thus far submitted. I am still suffering with back and neck pain. Can I ask for future pain and suffering compensation from the insurance company?(as I still will be seeing the doctor off and on for pain for some time to come,creating more bills to pay.) What is the procedure to do this?

A lawyer told me I had 2 years to file a claim but the other drivers Insurance company wrote and said if I had no more outstanding bills to submit they would be closing my case. (submitted last current bills in February) Do I need to file papers or something? Can they close case before 2 years are up?

Lastly, can I write the insurance company and tell them I am ready to setlle the case and how much I am willing to settle for to close the case?

it does not matter if the insurance company closes their file or not, you would still have two years to file a claim after which time you would be forever barred. it would not be in your best interest to write to the insurance company or have any contact with them regarding the settlement of your case. without a lawyer, the insurance company will take advantage of you and will not provide you the compensation you deserve to compensate you for pain and suffering, loss of enjoyment of life, disability, etc. i would recommend that you seek legal counsel which should not cost you anything. most personal injury lawyers would take a case like yours on a contingent fee meaning that you only pay them if you recover. after obtaining your medical records, and possibly having you evaluated by a doctor to determine if your injury is permanent, a good lawyer will be able to evaluate your claim and advise you as to what your case might be worth. good luck to you.
