Car Accident

What is the name of your state? Missouri

I was in a car wreck on Friday,June 20 2003.Some guy hit me and is at fault 100%.(that came from his insurance co.) My question is How do you know what to settle for? I was banged up enough I'm off work for a week and my van was totaled. My mom was also in the car with me,she also was banged up a little too. I'm not asking to retire I'm just not sure what would be fair for all of us. Can you advise me please? Thank You

This is what I was told...

First your vehicle is seperate as it is Property damage. You should get what your vehicle was valued at. Again *should*...

Next is the personal injury. Total up all your medical bills, days missed for work (if a week, thus a week's salary), etc. You should get around four times the total of those, give or take.

My attorney started, what we feel, is a little high. The insurance company normally comes in extremely low and this will allow room to bicker.

Good Luck.

Question

Are you saying that the pain and suffering should equal 4x the expenses? I am in a similar situation, except I am out of work now for the 4th week. I am trying to figure out if I need a lawyer or not. If I don't get a lawyer, I'm just trying to find out what would be a good pain and suffering dollar amount. Don't want to get a lawyer if the dollar amount isn't going to be that high and then I'd have to give him a third of it.
