In Illinois, I am going to be given a check for my car, which is unrepairable, by an insurance company that says that they are not liable for storage time at the body shop it is located at, even though they have taken almost a month to figure out a reasonable amount to pay me for my car. The charge is going to be almost $700 and I need to know if there is any kind of law that says they are responsible for that amount? If there isn't, can I take them or the motorist they insure to small claims court to get that money back?
