Hi:

December 1 at 1400 my wife was involved in an accident with a 2nd party. She was starting to back out of our property onto the street - maybe a few inches... the 2nd party was going in an excsessive speed and hit our car - swinging the car to the side of the road...

We contacted his insurance to file claim - they will not do anything - stating it was my wife's fault for backing out...

The conditions were a wet road.... He was clearly speeding - and was given a warning for it...

Is there ANYTHING we can do?????

We have no car now - and he is still driving his....

Help is needed... Very urgently... as we have 3 children - who have a genetic bone disease and if one of them ever fell (even minor) - it would mean a break and trip to the Children's Hospital which is a 30 minute drive!!

Based on your post, your wife is at fault for the accident. File a claim with your insurance company. Her negligence in not making sure the road was clear far outweighs the claim of excessive speed.
