Car Accident Not My Fault


What is the name of your state (only U.S. law)?
Texas

OK i'll try and make this brief, I was in a car accident other party was completely at fault. Since then they're doing their best to avoid my insurance agent. He's sent letters and phone calls but she won't reply. Oh yeah my car was totalled. Because of this i'm missing work, I didn't have rental ..but how do I get reimbursed for missed work if the other party has no insurance and refuses all points of contact that my insurance agent is trying to make? I live outside city limits about 15 miles outside city limits so public transportation isn't even an option and regardless if it was I drive my car for a living ..so im just trying to figure out how I get my money for missed work?

You rent a car and sue him for the cost. You keep working, because you're not entitled to compensation for missed work unless you are injured and physically UNABLE to work.

I wish I could, unfortunately I live paycheck to paycheck and have a daughter to raise ..I can't afford to rent a car period

I'm missing something - why is YOUR insurance agent working on this and not working on getting a check to you for the value of your vehicle so that you can purchase a replacement?

Then you should have had rental coverage on your insurance. You have to incur the expense before you can sue for reimbursement. Are you sure he doesn't have insurance? Your insurance company should be able to run a DMV report to find out what he has and then contact them directly.

My insurance agent told me that by law they have to give the other party 30 days to repond to him. Since the other person had no insurance they can't just write a check and pay for my car right away. Dosen't make sense to me either but he said after the 30 days and if he dosen't hear from her then they'll pay for the car. I have no idea why they have to wait 30 days but that is what he told me. I don't have rental insurance on my policy. I know this dosen't seem to make sense. Dosen't make sense to me either. I feel like im missing something to here.

You sir, are in a pickle.

Since you were not covered more (rental coverage) and you cannot go out of pocket to pay for the rental for yourself, you cannot provide the proof, that is what you were out, when it comes time to sue him for the money you are out, due to the accident. I hope you have collision coverage, or else you are really really screwed. but you can sue him for the value of your car before it was wrecked.

If the agent says 30 days, then he has 30 days to respond. I don't see why your agent would try to keep you from filing a claim with the company. Did you submit your claim to your insurance company yourself? I have never heard of such a provision, but your agent is licensed in TX, so I would assume he would know.
